A Journalist Versus A Corrupted System?   Posted on Mar 1, 2013    Comments (0)

The Union Home Ministry has sent a letter ticking off the National Human Rights Commission and the Tamil Nadu Human Rights Commission for a slipshod disposal of an issue concerning the human rights of a journalist - one TSV Hari.

 

Its copy has been reached to the relevant authorities in Chennai.

 

Is the simple hushing-up of a Human Rights’ issue of a journalist the tip of an iceberg that can sink the political Titanic of India due to the machinations of the wily political veteran M Karunanidhi?

 

That is what I sincerely believe in.

 

The Chennai City Police had been given a piece of paper from the Union Home Ministry February 28 2013.

 

Ref: F. No. 15011/41/2013-HR-II

 

It is an official copy of a letter written to the Registrar (Law) National Human Rights Commission Feb 25 2013.

Complaint from TSV Hari … regarding violation of Human Rights

 

It is observed … that the complainant is not satisfied with the action already taken so far on the complaint filed with the NHRC as well as SHRC.

 

It is requested to have this complaint looked into once again particularly keeping in view the facts stated on pages 5 to 9 of his letter and the action taken/status report on the above complaint may please be communicated to this Ministry immediately for submission to the Hon’ble Home Minister.

 

Complaints preferred by me had been declared ‘closed’ twice by Jayanti [IAS retired] Member, State Human Rights Commission [Tamil Nadu] completely accepting a totally flawed police version.

 

Mrs Jayanti had even lied in her judgement saying I was present during the conduction of the case.

 

I keep referring to it as Shameless, [In]Human Rigid Commission-taking organisation. 

 

One T Rajendran, Additional Director General of Police – the very man against whom serious allegations have been made is sitting as the chief of investigations of the Tamil Nadu Human Rights’ Commission – the very body meant grant redress to those persons whose human rights are violated stymying all efforts to seek justice.

 

The buck is being passed at the office of Chennai Police Commissioner - where officers at the level of inspectors and deputy superintendents of police are expected to investigate into matters concerning ADGPs!

 

So, here is a complete backgrounder about the whole thing and all its polemics in pristine glory.

 

I had alleged that the so-called declaration of the killing of Tamil Tiger terrorist Prabhakaran was a sham.

I had pointed out that the then Commissioner of Police T Rajendran and ex-DGP Letika Saran had a lot to hide in the triple murder in November 2008 of one Dr Saravanan, former CMD, Tamil Nadu Minerals.

I had alleged that T Rajendran also has a huge hand in the hushing up of the murder of Sadiq Batcha, former assistant of 2G scandal-tainted ex-central minister A Raja.

 

The scandal, I had alleged is worth much more than the Rs.1.76 lakh crores.

For those ‘crimes’ I was and am still being hounded by Rajendran in his capacity as the Additional Director General of Police, in charge of investigations at the Tamil Nadu State Human Rights Commission.

 

I have very strong reasons to suspect Rajendran is an agent of former Chief Minister M Karunanidhi who is masterminding moves to finish off the political existence of Chief Minister J Jayalalithaa.

 

He also is hushing-up several other crimes and those, in my opinion, include the massive granite export scandal, which, again in my opinion, is worth at least around Rs.20 lakh crores!

 

Some 3 years ago, on this very day – i.e. March 1 2010, I wrote a blog under the heading Pardon the Gaffe!

At that time, I was in a hospital owned by the brother-in-law of the current Union Finance Minister P Chidambaram – undergoing treatment for a heart ailment – to be precise – my second heart attack.

 

My blog was part of my endeavour to rehabilitate myself mentally.

 

On March 7 2010, around 0215 hours [2-15 a.m., to be precise] 3 policemen raided room 303 in Aswene Soundra Hospital, on Kasturi Rangan Salai, located within Teynampet Police Station limits.

 

The leader of the raiding party claimed to be Ashok Kumar, Superintendent of Police, “Q” Branch – the anti-extremist wing of Tamil Nadu police.

 

[Ironically, I still do not know who the man who claimed to be Ashok Kumar really was. But, the incident resulted in my coming to know the real Ashok Kumar, who is probably retired or about to retire as Superintendent of Police. He has become a friend for life.]

 

All my documents, phones, laptop computer etc were taken away. The seized material included my medical records too!

 

The raiders did not show any id, were not in uniform, did not reveal what case was involved and resolutely refused to state anything.

 

A duty doctor woke me up despite being under mild sedation obviously under orders of the police, identified that the raiders were from the police department.

 

Quaking with anger, I told the cops that within 48 hours, I would make sure that I got my stuff back from the cops.

 

The doctor on duty was aghast.

 

You are a heart patient, Hari. You cannot become emotional like this, he said.

 

There were other heart patients in the hospital and could perhaps not take any shocks on my account as the cops – if they were from “Q” Branch – could come back with heavily armed police personnel to ‘arrest’ a dangerous left and/or right wing armed desperado – poor old TSV Hari.

 

So, I volunteered to leave the hospital despite being under extreme stress – waking up the kind lady – Dr Meera Sadayavel at that ungodly hour.

 

“I have survived such things. Others may not. You can say I ran away from the hospital without paying the bills. I do not want the death of your other patients on my hands. If needed, please feel free to file a criminal case against me,” I told her.

 

“Don’t be silly  and stupid. We will  properly discharge you!”

 

That is the operative portion of my conversation with Dr Meera, who is now much more than a benevolent sister to me.

 

Policemen standing outside the hospital tried to stop me … but allowed me to go away in my car ... that had been kept parked nearby … with the help of a call driver.

 

The fact that no journalist body or organisation meant to protect civil rights bothered to lift one little finger to accuse the police of violating what are my inalienable human rights officially or otherwise and that I had to fight for survival myself is one aside.

 

Another aside is that this single journalist was able to wrest the seized material from the police within 24 hours, single-handed in the presence of the same Dr Meera from police officers - one ACP Raveendran and one Inspector of Police Bhaskar!

 

[The irony of the matter is that the same Raveendran is posted to the Central Crime Branch in City Police. When another officer apparently referred the matter, he reportedly remarked, We have closed that busybody Hari matter long back. It is all over!]

 

[There are other bits of ironies. The then Deputy Commissioner Crime General in charge of CCB - Sridhar IPS, who admitted to the raid is now promoted as Deputy Inspector General and is in the Crime Branch CID - the elite organisation meant to enquire into the gaffes of ordinary cops in the Central Crime Branch! The other irony is that there is this yellow magazine Nakkeeran that claimed to have investigated a sex scandal in a premier Hindu Mutt located in Chennai and published 3 snaps from it as a trailer. That audio-visual had resided in my computer for over a year. I had parted with its copy to the an ADGP requesting him to quell the distribution of the material and warn the religious organisation. He perhaps did. But, the so-called investigative magazine Nakkeeran managed to lay its hands on something imprisoned in my computer within 72 hours of its being seized by the police. When I pointed this out to the Editor/Publisher of Nakkeeran, one RR Gopal, he did not reply, but stopped the publication of the investigative report! The polite word is that Sridhar became richer by Rs.12 lakhs and Gopal had booked a popular TV channel for doing a repeat of the sleazy stuff a la fake Swami Nityananda! One of the reasons for both of them being cross with me is that my writing the email spoiled the chances of the duo making more money!]

 

Meanwhile the police department’s sections headed by persons with suspected criminal tendencies like Rajendran continue to make the life of one TSV Hari a misery by incessant spread of disinformation.

 

For the sake perspective, kindly remember the following:

 

  • The hospital is located within 500 metres of the Lankan Deputy High Commission

 

  • The hospital is located within 1 km of the two ‘official’ residences of M Karunanidhi, then Chief Minister of Tamil Nadu.

 

  • The hospital is located within 2 km of the police headquarters.

 

  • The hospital is located within 2 km of the Consulate of the United States of America.

 

Several months later, on 26/11/2010, the police said in writing about that raid as recorded by the Tamil Nadu Human Rights’ Commission in its order dated November 10 2011 as follows (my comments are appended below each paragraph):

 

The report of the Joint Commissioner of Police, South Zone Chennai, sent to National Human Rights Commission, New Delhi along with the report of Deputy Commissioner of Police Mylapore, Chennai, was received by this Commission on 26.11.2010.

 

The reply was supposed to be sent by the Director General of Police Letika Saran.

 

She merely forwarded the report of a deputy commissioner, that had been, in turn forwarded by a Joint Commissioner.

 

The report reveals that based on a tip off from a confidential source that a person whose name and address not known at that time, is indulging in some unlawful activities using electronic equipments [sic] detrimental to law and order and security of the State, is undergoing treatment at No. 303, Aswini Soundara Hospital, Kasturi Rangan Salai, Teynampet, Chennai 18, a special team enquired the complainant Mr TSV Hari on 7.3.2010. During the course of enquiry the properties of electronic items belongs [sic] to the complainant were verified by the CCB and returned to the complainant after verification.

 

It would be very interesting to know as to which part of the original sentence is meant to be correct. The police department says it did not know who the name, address and details of the agent provocateur but adds in the same sentence that it discovered the bad guy in a specific location.

 

What is more, at the specific location, doctors are aware as to why TSV Hari was there as an in-patient under medical insurance.

 

Yet, the police took away on the equipment and did not arrest the person whose acts were detrimental to the state and society!

 

During the enquiry, the complainant was not ill treated [sic] and the particulars were verified for the sake of maintenance of law and order. The enquiry was conducted on larger interest for the sake of law and order. The enquiry was conducted on larger interest for the safety and security of the society and no violation was committed.

 

Is waking up a patient under sedation in a hospital while undergoing treatment for a heart ailment at around 02-15 hours not ill-treatment?

 

Should the patient have been beaten up?

 

The commission directed the Investigation Division of the commission to submit its report on this matter. The report submitted by the Investigation Division, SHRC reveals that the complainant Mr TSV Hari was admitted in Room No. 303, Aswini Soundara Hospital for treatment.

 

Even after the treatment was completed, he continued to stay at the Hospital for few more days on his special request.

 

Now, that is a slur on the hospital run by close relatives of a cabinet minister at the centre who was then the Union Home Minister and now is the Union Finance Minister.

 

Does the investigating officer possess any record to make such an averment?

 

The complainant was enquired at the Hospital by the police team on receipt of confidential information by the police department that some one [sic] while staying in Hospital is doing unlawful activities through electronic equipments [sic]. The electronic goods received from the complainant were returned within a day after verification by the police department in CCB (Cyber Crime).

 

In other words, the police department admits to all the allegations made by TSV Hari.

So, what did one TSV Hari write in the blog on March 1 2010?

 

In that, among other things, I pointed out that comprehensive evidence to prove that V Prabhakaran had been slain by the Lankan Government on May 18 2009 had not been given.

 

The two operative counts were:

 

  1. India had and continues to have the fingerprints of Prabhakaran taken in 1981 and 1986. If the body was that of Prabhakaran on May 18 2009, it would have been very easy to take the fingerprints off the body and compare them with those in India openly before television cameras. That was never done.

 

  1. The Lankan regime had Prabhakaran’s parents within its reach. A DNA report would have confirmed to all and sundry that Prabhakaran had indeed been killed in action. The Government of Sri Lanka is yet to do it.

 

So I said that nobody with a sane mind would acceptable television pictures of a body that proclaimed a person as so and so implying anyone can be depicted as anyone in these days of plastic surgery.

 

There were other holes in the story of Prabhakaran killing tale.

 

The run-up that had been exposed in detail:

 

In Sri Lanka, an elected government did to death a huge section of its own ethnic minority.

 

Had it not been for the following set of events that cannot be contradicted, busybodies like me would not have asked whether the body ‘paraded’ for the benefit of television cameras May 18 2009 indeed was V Prabhakaran whose activities had been winked at by the intelligence agencies of the world at large and by India for over 30 years:

 

  • 2004: Vinayagamurthy Muralidharan alias Colonel Karuna Amman – Prabhakaran’s virtual second in command and personal bodyguard broke away from the LTTE and declared that the eastern province of Batticoloa whose youths were denied a future by the LTTE were breaking away...

 

  • 2006--2007: Lankan army wrested control of The East from former LTTE operatives...

 

  • 2007: Karuna arrested in UK for possession of false passport, immigration fraud and he claimed in open court that the offending document had been ‘supplied’ by none other than the Lankan President’s brother Gotabaya!

 

  • January 2008: Karuna sentenced to 9 months in prison in UK as civil rights activists demand his trial for war crimes.

 

  • July 2008: All charges against Karuna [including war crimes, deployment of child soldiers and torture of political dissidents levelled by the Lankan government itself in the past] were suddenly dropped and he returned to Lanka with a valid travel document to become an MP. His ‘assistant’ Pillaiyan becomes Chief Minister of Batticoloa!

 

  • August-December 2008: LTTE loses heavily and retreats towards the sea

 

  • January 2009: Fonseka says Prabhakaran escaped and contradicts statement within 48 hours

 

  • March 2009: Karuna joins Sri Lanka Freedom Party, becomes minister for National Integration!

 

  • May 18 2009 Prabhakaran’s ‘body’ shown on Indian/foreign television.

 

There were many holes in this story, more in number than Swiss cheese.

 

  1. Initial reports said Prabhakaran was killed while trying escape from the battlefield.

 

Would a man trying to escape wear his battle fatigues and also sport a name tag on his chest, which the so-called body of Prabhakaran was featured as having?

 

  1. DNA tests will soon prove the obvious, someone said in Colombo. The results of the tests, if ever done, were never revealed.

 

  1. The then generalissimo of the Lankan army Sarat Fonseka had told journalists January 18 2009 that he had suspected the possible escape of Prabhakaran from the war-torn island. Fonseka changed his story within 48 hours.

 

May 18 2009, the day, a body was paraded before the global television channels’ cameras – terming it that of V Prabhakaran, Fonseka was a hero.

 

Within months, after contesting against the incumbent President Rajapaksa, he was rendered a zero and sent to prison!

 

Was Fonseka imprisoned for letting the cat out of the bag?

 

But the whole world had accepted that Prabhakaran had been killed and the television channels proclaimed that quoting senior government honchos.

 

So that implies either of the two possibilities:

 

  1. Prabhakaran had escaped Lanka as Fonseka had said and the entire drama enacted for the benefit of television cameras was a massive cover-up.

 

Prabhakaran’s escape was perhaps, I ventured to say in subsequent blogs, the same international deal as was openly cut with personalities like Pervez Musharraf [who did what Prabhakaran did, but in the official capacity of being the head of state of Pakistan].

 

Prabhakaran would remain alive elsewhere in the world quietly as part of the quid pro quo – to be cocooned and kept alive to launch a fresh offensive against Lanka whenever geopolitical needs would necessitate such a step, I had added.

 

In hindsight, isn't that happening now after those pictures of his slain son are surfacing with a grim regularity?

 

I had pointed out that Osama bin Laden would be binned as well more or less the same way as Prabhakaran – with gaping holes in that future story.

 

That too happened – as I have in my possession an Islamabad datelined Associated Press report that said that Osama had been killed a few weeks before.

 

Some 28 minutes later, Barack Obama went on live television saying that his navy seals had laid Osama low a few hours ago!

 

Let me, however, make a distinction here.

 

US President Barack Obama went on record stating that his government has evidence to prove his nation's naval seals had killed Osama.

 

I have reasons to completely believe Obama on this count.

 

  1. Prabhakaran was probably killed before May 18 2009 and his body had been disposed of. For the sake of appearances, the charade had been staged by the Lankan regime as part of some international deal.

 

As per that deal, world regimes possibly accepted that silly story and commented as though the Lankan politicians were revealing parts of The Gospel Truth.

 

That deal, obviously, has gone sour as credible organisations such as the United Nations have time and again slammed Lanka for its poor human rights’ record with telling evidence.

 

The surest sign of it emerges from one little thing: The red corner notice against Prabhakaran was withdrawn by the centre from the TADA court in the outskirts of Chennai in December 2010 - i.e. 17 months after the assassination story was accepted on the floors of India's parliament!

 

The relevant officials of the Home Ministry could not have been sleeping.

 

So, someone had a lot more to hide on the so-called Prabhakaran slaying!

 

Worse, Chidambaram has gone on record several times saying he has irrefutable evidence about Prabhakaran having been killed.

 

He has not revealed what the evidence is, at all, so far!

 

Rajapaksa is always as much a devil as Saddam Hussein and Muammar Quadhafi were.

 

And like the two mentioned above were used and then discarded by the West, so will Rajapaksa.

 

These were my inferences drawn in the blogs under that Pardon the Gaffe series.

 

Karunanidhi always had nursed fissiparous tendencies and criminally encouraged them.

 

Karunanidhi supported the Tamil terrorism in Lanka, belittled the Indian army, belittled the supreme sacrifice of Rajiv Gandhi, was accused of having had a hand in the conspiracy that led to Rajiv Gandhi’s murder, has had his governments dismissed twice at the instance of the Congress for corrupt and anti-national activities and whose participation in the Gujral-led coalition ministry at the centre had caused the government to be toppled.

 

Karunanidhi always targeted those who exposed this perfidy – at times with violence. One example is the editor of Thuglak magazine Cho S Ramaswamy.

 

There is a long list of journalist victims of starting from those who had worked for a newspaper called Navamani.

 

Karunanidhi had tried to mastermind controlling the rule of MGR upon his return from the US of A in 1985 after the latter’s heroic fight with a debilitating illness by using the then Chief Secretary Chokkalingam and other political agent provocateurs like RM Veerappan and VR Nedunchezhiyan besides a band of select police officials like BP Rangaswamy.

 

The plan was foiled by none other than MGR’s faithful cop Mohandas and his then deputy A.X. Alexander [the latter is still alive and living in retirement].

 

I have strong reasons to believe that Karunanidhi is attempting to do the same thing to Jayalalithaa through his minions like Rajendran who are close to the Mannargudi Mafia led by none other than Sasikala who is Karunanidhi's moll destroying the AIADMK from the inside and leaving Jayalalithaa an emotional wreck.

 

There are various police officials who swear that during the first tenure of Jayalalithaa as CM, a resignation letter landed on the table of Karunanidhi thanks to Sasikala and her husband Natarajan!

 

There are 3 sides to this political coin.

 

The rarely noticed rim:

 

Jayalalithaa is equidistant from both the right wing Bharatiya Janata Party and the centrist Congress. If there is a third front, she is a strong contender to either lead it or be a lead player. Karunanidhi is indeed interested in spoiling that possibility permanently - just as he spoiled the chances of one G.K. Moopanar in the past!

 

The heads’ side:

 

Using corrupt sections of the police department, the political and other moves of Jayalalithaa are being controlled  and masterminded quietly by Karunanidhi. The wily octogenarian politician is planting wrong intelligence reports with a near ineffective Director General of Police at the helm of affairs in the form of K Ramanujam – whose extended term is forcing him not to take any major decision to steer clear of controversy.

 

The same side also helps the hushing up of the Sadiq Batcha murder case that can blow the lid off the 2G spectrum scandal, the hushed up triple murder of Dr Saravanan, his wife and servant maid to bury the Rs.20 lakh crore plus granite export scandal.

 

Now, Raja wants to depose before the Joint Parliamentary Committee.

 

Will he tell all?

 

Or is Rajendran the ruse to divert attention from various vital issues in the already hushed up Sadiq Batcha murder case before finally silencing Raja himself?

 

The Lankan imbroglio is also being very cleverly used by Karunanidhi.

 

The Sethusamudram Shipping Canal Project was meant to help only the Liberation Tigers of Tamil Eelam because only ships of 30,000 MT DWT and below could traverse the canal if ever completed.

 

Such ships number less than 10,000. Most of them are either directly or indirectly owned by benamis of the same LTTE! Some of those close to Karunanidhi are alleged to be partners in this shipping syndicate.

 

To recover the money already spent and to be spent, one would require 50 years during which each year, some 15,000 ships of the 30,000 MT displacement weight category ought to dock annually in Tuticorin port to make the canal viable.

 

The cess is said to be Rs. 5 lakhs per trip.

 

So far over Rs.8000 crores have been spent.

 

If the project is ever finished, the bill would go well beyond Rs.20,000 crores.

 

Originally, one expected 30 years as the time to recover costs estimated to be Rs.2300 crores.

 

Now, to get this, how much would one have to wait?

 

For so many ships to dock, one has to make industrial products for import and export.

 

That would mean some a few lakh crores in terms of electricity, roads and other infrastructure.

 

Where should one find that money?

 

In a nutshell that was a project never meant to take off but just net commissions, more commissions and most commissions to the DMK.

 

The manager of these commission deals - one TR Baalu lost his cabinet post.

 

The vessels to do the dredging have ownerships in the names of persons said to be related to Baalu either by blood or through business.

 

An intelligence report in this regard led to his ouster from the Union Cabinet.

 

In this bargain, the Ram Sethu would be destroyed leading to political unrest in Tamil Nadu to the headache of Jayalalithaa and as a slur upon the Hindu majority of India.

 

In this regard, the centre has already rejected the Pachauri report!

 

Finally, to create unrest in Tamil Nadu, statutory bodies like the Supreme Court and various ministries of the centre would be blamed for creating stumbling blocks in the paths of progress of southern Tamil Nadu, which is already known for its violence!

 

And which political party's support base is it?

 

That of the ruling All India Anna Dravida Munnetra Kazhagam led by J Jayalalithaa, currently Chief Minister of Tamil Nadu.

 

Is she facing any threat?

 

Yes, indeed, from the organisations like the Liberation Tigers of Tamil Eelam who are perhaps bigger villains than the Lankan regime for having killed one too many innocent Tamils to retain their reign of terror and intimidation in the Liberated Land!

 

In such an endeavour, the group murdered two persons who went out of their way to help them ...

 

One was Rajiv Gandhi and the other Ranasinghe Premadasa - Prime Ministers of India and Lanka respectively.

 

Is this all directed to keep the Lankan imbroglio further murky as to never solve the issue while pretending to do so?

 

Is the whole thing aimed at the UN conference scheduled for Geneva where the Tamils' issue may be discussed threadbare?

 

The tails’ side:

 

By doing all this, Jayalalithaa will be kept busy feeling through murky political waters while Karunanidhi masterminds the comeback of birthday boy M.K. Stalin after besting the other bad boy of the Dravida Munnetra Kazhagam – M.K. Alagiri – hushing the huge fertiliser scandal that is straining at the leashes tightly held by none other than P Chidambaram of the Congress who presented the budget the other day to favour his cousin A.C. Muthiah, who heads a loss-making corporate entity called SPIC.

 

Is that the plan to keep Rajendran in a so called innocuous post as the investigating officer of the State Human Rights’ Commission on the one side but using him to hush up all the matters once and for all – raised by one poor old TSV Hari?

 

Is this ‘endeavour’ is also supposed to boost the chances of Karti Chidambaram to become either king or king-maker in Tamil Nadu by his Harvard educated father Palaniappan Chidambaram who once had to depend on zeroes of Tamil Nadu politics like thespian Shivaji Ganeshan and who hopes to become Prime Minister of India himself in the same style as P. V. Narasimha Rao and/or Dr Manmohan Singh?
