Pardon the Gaffe Again - V - Three Jeers For India's Press Freedom!   Posted on Jul 6, 2012    Comments (0)

There is a rather unique species on earth – one TSV Hari, the only non-human-journalist - and ipso facto without any rights.

 

An IAS officer Mrs Jayanthi has closed a matter – perhaps erroneously deemed by me as concerning my human rights.

 

To wit, she went on record saying the Tamil Nadu police admitted to waking up journalist TSV Hari, at the ungodly hour of 2-15 a.m. on March 7 2010 when the journalist was undergoing treatment for cardiac arrest in a hospital owned by close relatives of Union Home Minister P Chidambaram, by a specially constituted police team that discerned that the said TSV Hari, was a threat to the safety and security of the state of Tamil Nadu.

 

The police team took away the personal computer and several other personal effects of the journalist concerned – poor old me – despite the duty doctor one gentleman Dr Praveen saying TSV Hari is indeed a journalist.

 

The police officials did not disclose their identity then or till now and are yet to disclose what dangers did the journalist in question pose to security of the state of Tamil Nadu that necessitated his being woken up at that hour during what can be termed a raid.

 

 

Despite the danger of inviting upon himself the possibility of worsening his health, TSV Hari left the hospital that late night because there were very sick and cardiac patients in the hospital.

 

The police could always say that TSV Hari was, is and will be a dangerous terrorist and raid the hospital again – this time with a huge contingent and with the help of heavily armed commandos.

 

The commotion, the journalist reckoned, could kill those in the hospital with weaker hearts.

 

So, he woke Dr Meera – who maintains the hospital with a kindness not generally known to those who visit hospitals at that hour and offered to “run away from hospital’ to save the other patients’ lives.

 

“Do not be silly, Hari. Simply sign on the papers and leave. We will mention in the files that you are being discharged. As regards the amount you still owe to the hospital, you may pay whenever you have the money after the insurance cash portion has been settled,” Dr Meera said.

 

So I left that night by my car – made it appear that I had resorted to flight by cross the borders of Tamil Nadu into the Union Territory of Puducherry.

 

But, a few phone calls later, I was emboldened to return because of what I had heard.

 

I called the then Director General of Police Letika Saran, who had been some kind a friend till then on phone and said the police under her command should not have done what it did to someone who is supposed to be the friend of the DGP.

 

“You must have done something wrong no? Else, why should the police officials – whom you have never seen do what they did?”

 

I told Letika that she no longer was my friend.

 

“One day, you will regret this,” I told her later in person.

 

My computer and other personal effects were returned within 36 hours of the seizure.

 

I preferred a complaint to the National Human Rights Commission is reacted upon with alacrity March 10 2010.

 

The NHRC demanded an explanation from Letika within 4 weeks.

 

For no apparent reason, the matter was transferred to the State Human Rights Commission in Tamil Nadu some 2 months later.

 

The SHRC in turn demanded an explanation within 4 weeks.

 

Letika forwarded a note written by an officer some 5 months later in October 2010.

 

In that letter, the police admitted to all the allegations made by TSV Hari but insisted that Hari’s human rights were not violated.

 

The matter was recorded in several blogs, reported in newspapers, and so on.

 

Nothing happened.

The inevitable and unenviable situation of ineffectiveness in the disposal of yet another global fall guy called Osama like others before him with the painful mass-murder of innocent millions as in the case of Iraq, Afghanistan and Sri Lanka has been long overdue.

 

Else, the West would not have pumped in the equivalent of over US$ 90 billion into the bouquet of Islamic Republics Azerbaijan, Kazakhstan, Kirghizia, Tajikistan, Turkmenistan, and Uzbekistan located south east of what once was the Soviet Union and northwest of Afghanistan. (Source PWC, BNE etc.)

 

Pakistan is being branded a mad dog [most of those living in Pakistan have suspended their intelligence and pandered to machinations beyond their borders for too long] by the first world’s press and lapped up by us gleefully in the run up to its being handed down a punishment akin to what was dished out to the LTTE, an avowed enemy of Islam, and yet, involved in issued based "cooperative relationships" with Al Qaeda and ISI.

 

Similar things happened to Saddam, several of the Afghan warlords and may happen to persons like Zardari, Musharraf and others.

 

Like in the case of former LTTE boss Prabhakaran no one can ever be sure of the final, future, fate of Osama who has desisted temptations of ‘decent burials’ like Saddam Hussein, Benazir Bhutto, President Ranasinghe Premadasa, Generals Zia Ur Rahman, Zia Ul Haq and Zulfiquar Ali Bhutto.

Within 7 days of my writing the above blog from a hospital bed where I was convalescing after a second, near fatal heart attack, the room was raided by a posse of policemen under the control of ‘journalist’ Chief Minister M Karunanidhi at around 2-15 a.m.

 

Mercifully, Karunanidhi and his accursed DMK has lost it at all at the hustings. Good riddance.

 

The hospital is owned by the brother-in-law of Union Home Minister P Chidambaram.

 

And I was under the care of Chennai’s senior lawyer Nalini Chidambaram’s sister-in-law Dr Meera Sadayavel Kailasam.

 

The duty doctors had all along informed the police that I am a senior journalist.

 

The police saw my id.

 

All my personal effects including my laptop computer, portable hard disk, medical records and other personal effects were ‘seized’ by 3 cops claiming to be from the dreaded ‘Q’ Branch [anti-extremist wing] who neither provided any evidence as to who they are like names, designation blah, blah or any reference to any case.

 

While none from the Chennai press corps even as much as lodged a whimper of a protest, through my own perseverance, I retrieved my effects on 8.3.2010 handed over to me by one Bhaskar, Inspector of Police, Abhiramapuram, in the presence of Dr Meera.

 

I complained to the National Human Rights Commission by March 10 2010 – with the evidence of the seizure naming the Director General of Police Letika Saran as an accused.

 

The NHRC initially demanded an explanation from the state police DGP vide Ref: NHRC Case No. 314/ 22/ 13/2010 UC/SBII RC No. P&G [S] 1/ 66/ 6852/ NHRC/2010 within 4 weeks.

 

Some 2 months’ plus later, the NHRC transferred the matter even without getting a reply from Letika Saran to the State Human Rights Commission.

 

The SHRC demanded a similar explanation vide its case 4172/2010.

 

The SHRC received the copy of a letter from the DGP [not the DGP’s explanation but a communiqué to her by her subordinate a deputy commissioner of police] in early 2011 thus:

Ref: NHRC Case No. 314/22/13/2010 UC/SBII RC No. P&G[S] 1/66/6852/NHRC/2010

 

In the...referred petition...TSV Hari stated that on 7-03-2010 a police party in the night seized his laptop, cellphone [sic] and other important documents without disclosing anything.

 

In this regard enquiry has been conducted by ACP Teynampet he sent his reply that, on receipt of a confidential information that a person whose name and address not known at that time, is indulging in some unlawful activities using electronic equipments detrimental to the Law and Order and security of the State is under going [sic] treatment in No.303 Aswini Soundara Hospital, Kasturi Rangan Salai, Teynampet, Chennai 18, a special team enquired petitioner TSV Hari on 7-03-2010 who was in the above referred address. During the course of the enquiry the...properties were verified by the CCB [Central Crime Branch] and returned to the petitioner after verification.

 

During the enquiry, the petitioner was not ill-treated.

 

The police enquiry was conducted on large interest for the safety and security of the Society only. There was no violation by the special team.

 

No further action is required.

 

A friendly senior police officer said thus recently:

 

“Be thankful to God for small mercies. You predicted Osama’s end over a year back... The local cops here did not declare you a terrorist like Osama and bump you off in an encounter or imprison you under trumped up charges like another man in the north – Dr Binayak Sen. Supposing such a thing had happened, would anyone have bothered, including your friends from the journalistic fraternity?”

 

It does not matter to anyone that some sleaze-peddling Tamil magazine Nakkeeran managed to get some dirty pictures of a Hindu monk – a movie visual material imprisoned in my computer for nearly a year and with an Additional Director General of Police in Tamil Nadu without any ado within 48 hours of the seizure of my laptop computer.

 

The magazine tried to blackmail the Hindu religious institution by publishing 3 stills from the video and threatened the Hindu world with another Nityananda type expose [This self-styled "Yoga Guru" was featured in a sex video with an actress called Ranjita].

 

I still managed to stop that nonsense against the religious institution with a single letter to its editor demanding an explanation as to how the magazine got the material within 48 hours of my computer being seized by the police.

 

While the sane section of Indian media world knows the rather despicable character of those who run Nakkeeran, its decision makers are now under the microscope of the Central Bureau of Investigation for connections to the 2G Spectrum scam worth over Rs.1.75 trillion!

 

When I tried raising the matter with the then anti-press Chennai Commissioner of Police Rajendran, he threatened me with arrest.

 

The continuing persecution by Karunanidhi's police has so far made me suffer some 5 more cardiac arrests.

 

Short of killing me with bullets, the Tamil Nadu police have achieved almost everything else.

 

My strife and sweat to haul myself of the financial and wealth abyss created by them have cost me a fortune and have almost ruined me in monetary terms and have left me nearly dead after multiple heart attacks.

 

Luckily for me, but for my health and most of my wealth, I have not lost anything else - especially the will to fight till the bitter end.

 

My soul’s anger at the society’s inaction is somewhat assuaged with this recall.

 

Therefore, this is my Kaddish too...for my own injured soul.

 

TSV Hari wrote several blogs ... preferred complaints to as many ‘friends’ in the police department.

 

Several “investigations” later, an IAS officer and member of the State Human Rights Commission of Tamil Nadu Jayanthi said that she accepted the police version and has closed the case against TSV Hari since the human rights of TSV Hari were not violated at all.

 

Without saying in so many words, Mrs Jayanthi indicates that violation of human rights means that the person concerned should be beaten up.

TSV Hari ….. Complainant

 

ORDER

 

The complainant Thiru TSV Hari sent a complaint through email to the National Human Rights Commission on 11th March 2010 and the Commission NHRC has called for factual report from the Director General of Police, Tamil Nadu, Chennai on the averments made in the complaint. Subsequently, the National Human Rights Commission, New Delhi has forwarded the complaint to this Commission, under section 13 (6) of the Protection of Human Rights Act 1993 as amended by the Protection of Human Rights Amendment Act 2006, with an order that the grievances raised in the complaint relate to the subject matter of Tamil Nadu and also directed the Director General of Police Tamil Nadu to submit report to this Commission within four weeks. The said complaint was received by this Commission on 11th May 2010 and the same was registered and assigned the above number (SHRC 4172/2010). The crux of the contents of the complaint is that the Tamil Nadu Police Department’s Q branch has seized the complainant’s laptop computer, several of its accessories, personal papers, two mobile phones at 2-15 a.m. on 7th March 2010, while he was under treatment in Aswini Soundara Hospital at Chennai. All the seized goods were handed over to him on 8th March 2010 by Mr Raveendran, Assistant Commissioner of Police and Mr M.S. Bhaskar, Inspector of Police. Apprehending vindictive prosecution by local police which may lead to disastrous consequences, to his immediate safety and his family, he has not stated his address in the complaint. He has also stated that the matter is brought to the notice of the National Human Rights Commission, New Delhi to initiate appropriate action without any prejudice to his future compensation for medical complaints and mental agony.

 

2) The report of the Joint Commissioner of Police, South Zone Chennai, sent to National Human Rights Commission, New Delhi along with the report of Deputy Commissioner of Police Mylapore, Chennai, was received by this Commission on 26.11.2010. The report reveals that based on a tip off from a confidential source that a person whose name and address not known at that time, is indulging in some unlawful activities using electronic equipments [sic] detrimental to law and order and security of the State, is undergoing treatment at No. 303, Aswini Soundara Hospital, Kasturi Rangan Salai, Teynampet, Chennai 18, a special team enquired the complainant Mr TSV Hari on 7.3.2010. During the course of enquiry the properties of electronic items belongs [sic] to the complainant were verified by the CCB and returned to the complainant after verification. During the enquiry, the complainant was not ill treated [sic] and the particulars were verified for the sake of maintenance of law and order. The enquiry was conducted on larger interest for the sake of law and order. The enquiry was conducted on larger interest for the safety and security of the society and no violation was committed.

 

3) The commission directed the Investigation Division of the commission to submit its report on this matter. The report submitted by the Investigation Division, SHRC reveals that the complainant Mr TSV Hari was admitted in Room No. 303, Aswini Soundara Hospital for treatment. Even after the treatment was completed, he continued to stay at the Hospital for few more days on his special request. The complainant was enquired at the Hospital by the police team on receipt of confidential information by the police department that some one [sic] while staying in Hospital is doing unlawful activities through electronic equipments [sic]. The electronic goods received from the complainant were returned within a day after verification by the police department in CCB (Cyber Crime). The report concludes the police personnel have discharged their duty by giving due respect to the complainant and not committed any act of human rights violation.

 

4. In view of the above and after careful consideration of the allegations contained in the complaint and the report of the Investigation Division of State Human Rights Commission, the subject matter in short arrived at is that electronic goods were recovered by the police and returned to the complainant within a day as stated by the complainant without stating any reason while the complainant was admitted in the private hospital [sic]. He had apprehended for vindictive prosecution by local police and sent a complaint through e-mail to National Human Rights Commission, New Delhi without disclosing his address. The same was forwarded to this Commission and the report of the Investigation Division SHRC, sought by the Commission. The Investigation Division report reveals that the police authorities have enquired the complainant with due respect while he stayed in the private hospital after completion of his treatment. The authorities have recovered the electronic goods and returned the same with acknowledgement within a day after verification by CCB as the police have acted on a tip off confidential information that some one [sic] is staying in a private hospital and doing unlawful activities through electronic equipments. The police have acted on the interest of public safety and security and not committed any act of violation of human rights.

 

5) Considering all the above, the commission concludes that in the absence of any allegation in the complaint that the authorities have acted excessively and committed any violation, and the authorities have acted to discharge their official duties by giving respect as per the reports, the commission is satisfied that no further inquiry need be made as per section 17(1)(b) of the Protection of Human Rights Act, 1993 according. Hence the complaint in SHRC No. 4172 of 2010 is closed.

Well, the police ought to have named that despicable journalist TSV Hari a terrorist and shot him then and there as his “activities were suspected to be detrimental to the state of Tamil Nadu” as it was way back in 1981 when the same TSV Hari was assaulted by the police in Madurai along with the then PUCL President Retired Justice VM Tarkunde for protesting against police atrocities in Tamil Nadu against ordinary people.

 

The dangerous criminal that TSV Hari was, so described and charged under 124 A IPC [sedition] for attempting to violently overthrow the democratically elected government of Tamil Nadu in 1981, according to the prosecution, was armed with deadly weapons like a stick, a placard, the two stones and a camera. In pure self-defence one AP Mohammed Ali, then a DSP [later disgraced as the DIG in the unholiest Stamp Paper Scandal of all time that almost destroyed the real estate industry and several nationalised banks thanks to another gentleman - Abdul Karim Telgi] and some 40 policemen beat up the dangerously and heavily armed TSV Hari [as described above] and broke his right leg. 

 

That the same Mohammed Ali also had assaulted the former CM Karunanidhi when Jayalalithaa returned to power in 2001 needn’t be remembered by anyone in this context as TSV Hari is a not a human and does not have any rights at all.

 

The same TSV Hari had rescued some 3000 plus bonded labourers of Tamil Nadu only a month before in 1981 from Andhra Pradesh and had been hailed for that work on the front pages of The Hindu and the Indian Express ... and perhaps wrongly.

 

 

 

The immediate provocation for the raid in a hospital owned by the near and dear of Union Home Minister P Chidambaram was TSV Hari predicting a painful end for Osama bin Laden with all the loose ends as had been found in the so-called annihilation of V Prabhakaran. That blog had been written March 1 2010 - as part of the convalescence exercise after the second heart attack.

 

Among other things, TSV Hari is accused of naming Mrs Sonia Gandhi of being the main conspirator to kill none other than her husband Rajiv Gandhi.

Since then, the Tamil Nadu police led by the former Chennai Commissioner of Police Rajendran [whom Hari has accused of violating human rights ... and something overlooked by the NHRC and SHRC for Hari is not a human and therefore without rights at all] carried a vicious campaign against TSV Hari saying he had been probably raided by debt collectors, by the Q Branch for being an left and/or right-wing extremist and a trouble maker. Incidentally, Rajendran is the main investigating officer of the State Human Rights Commission - and Hari had accused Rajendran in his blogs of being an agent of former CM M Karunanidhi. Among other things, TSV Hari accused Rajendran of getting rid of the current CM J Jayalalithaa ... but that is yet another anti-state and anti-national act of TSV Hari the non-human-journalist without rights!

 

The same Mrs Jayanthi IAS in her report has accused the close relatives of P Chidambaram of running the Aswene Soundra Hospital [the correct spelling this time by yours truly] as a lodge by saying that the said TSV Hari had sought special permission to stay in the hospital even after his treatment, turning it into some kind of lodge!

 

That this non-human-journalist suffered 5 more heart attacks since then is a little aside one does not have to pay attention to.

 

That some of these attacks happened in Mumbai is another little needless footnote in the inconsequential life of TSV Hari and some of those medical bills were in fact met by a few police officials in Mumbai at the behest of a few police officials based in Chennai!

 

Believe it, folks!

 

Tamil Nadu is the state of progress - where the Commissioner of Police nicknamed Sari Pathi [rhyming with the family name Tripathi] arranges the retrieval of TSV Hari's investment in a TV Channel - after being called Sari Pathi to his face - and retrieves exactly 50% of the money. Since TSV Hari was almost on the streets then, TSV Hari expressed gratitude for the retrieval ... and still does so, in writing!

 

Is Hari being put to sword by some sections of the Tamil Nadu police for predicting the Osama fate some 13 months before the event took place and comparing it with the story of the Tamil Tiger Terrorist Prabhakaran whose assassination story has more holes than Swiss cheese?

 

If the answer to that is yes, the supplementary question: At Whose Behest?

 

Is TSV Hari being bothered by Rajendran because Hari exposed that Rajendran had managed to get 4 persons convicted of murdering former CMD of the state government owned Tamil Nadu Minerals Dr Saravanan, his wife and maid-servant as a triple murder for gain while actually the New Indian Express had stated in its report [authored by Gokul Vannan] that Dr Saravanan had huge Swiss Bank accounts? Is TSV Hari being penalised because Rajendran’s predecessor Radhakrishnan [both are ADGPs and IPS officers] had emphatically stated that nothing at all had been missing from the residence of the murdered Saravanan? If yes, is there something about the Swiss accounts as alleged by Gokul Vannan in the New Indian Express and does Rajendran have to do something about that money?

 

 

Is there a foreign hand angle to the whole thing because TSV Hari raised several tough questions about the so-called killing of Prabhakaran and identified similar holes in the matter concerning Osama?

 

But then, these could be mere surmises as TSV Hari is not a human at all. He is a robot masquerading as a journalist putting out tripe and hence has no human rights!

 

I beg all those who read this blog to file as many complaints against TSV Hari as an anti-national robot terrorist [like in the movie Ra-One or its earlier Tamil version starring Rajnikant] out to destroy India so that the police can shoot me down in cold blood putting an end to my misery!

 

I am saying I am a person called TSV Hari, with an unblemished record of 35 years in journalism.

 

The state apparatus ... despite the change in political guard is making a laughing stock of me and is saying the exact opposite.

 

Within 72 hours of my computer being seized by the police, a yellow Tamil language journal claimed to have "investigated" a sleaze scandal in a respected Math based the world over, attempted to blackmail the Math [despite the details having been given to the police some 9 months before the incident by none other than TSV Hari and issuance of warnings of sleaze peddling to the same Math's authorities] and published 3 stills from the sleaze video. The magazine did not release its investigative report after TSV Hari demanded an explanation from its editor by email.

 

That this magazine's mainstays were raided and questioned in the 2G scam by the CBI is another story.

 

Incidentally the IPS officer Sridhar who authorised the raid[?] was promoted and posted as Deputy Inspector of Police in the elite Crime Branch CID! 

 

The rumour is that a huge sum of money was given to Sridhar by the magazine and the latter is demanding its return!

 

The footnotes:

 

During the last reign, M Karunanidhi, the so-called journalist Chief Minister [who once upon a time had termed me his journalist younger brother in the official organ of his party] held the home portfolio.

 

Today Karunanidhi dismisses my accusations as those of a Hindu Brahmin against the Dravidians in support of the current Hindu Brahmin Chief Minister J Jayalalithaa.

 

 

During the current reign, the Chief Minister J Jayalalithaa is holding the home portfolio – and does not seem to be bothered one little bit about the fellow Hindu Brahmin whom she probably does not consider a journalist or a human being at all, despite the same person having exposed the perfidy of the former Chief Minister M Karunanidhi to plot a sinister method to assassinate her in the newly built secretariat in the heart of Chennai which is a scandal as big as the Himalayan 2G spectrum or perhaps bigger!

 

The closure report of the State Human Rights Commission [I substitute “Shameless” in the place of State] reveals that simply because this TSV Hari was not beaten up by the police in the hospital, his human rights were not violated and that the heart attack patient being disturbed at 0215 hours – while under semi-sedation was not a violation of the said TSV Hari’s human rights.

 

That the same TSV Hari suffered more cardiac arrests is also not important – even if TSV Hari is in possession of medical records to prove the attacks.

 

Three jeers for press freedom in India!

 

And three smears for India's democracy!
